What is Article 37 of Indian Constitution
In simpler terms, Article 37 can be summarized as follows:
- Not Enforceable by Courts: The provisions within the Directive Principles of State Policy (Part IV of the Constitution) are not legally enforceable by any court. Citizens cannot directly go to court to seek their enforcement against the government.
- Fundamental Principles: However, the principles outlined in the Directive Principles are considered fundamental in the governance of the country. They serve as guidelines and ideals for the government to follow when making laws and policies.
- Duty of the State: It is the duty of the State (the government) to apply these principles in the process of making laws and policies. While they may not be enforceable in a court of law, they are expected to inform and guide the actions of the government in fulfilling its responsibilities to the people.
Article 37 reflects the balancing act in the Indian Constitution between fundamental rights (which are justiciable) and directive principles (which are not directly enforceable but are nonetheless crucial for governance). The Directive Principles provide a roadmap for achieving socio-economic justice and a welfare state in India.
